The office of Senator Bryan Townsend, and Darlene Battle, founder of the Coalition United for Safer Roads for All Delawareans, organized all the efforts to get to the first Rally and Hearing for the Driving Privilege Cards and Trust Act legislation at Legislative Hall in Dover on June 10, 2015, and advance the first step. The first victory is done: it passed to full discussion by Senators.
The Driving Privilege Cards SB59 and Trust Act SB60 have a bi-partisan sponsorship. The originator sponsor of the bill is Democrat Senator Brian Townsend. The additional sponsors are Democrats Senator Robert I. Marshall (Wilmington West), Representative Helene M. Keeley (Wilmington South), and Republican Representative Joe Miro (Pike Creek Valley). The Co-Sponsors are Democrats Senator David McBride (Hawk’s Nest), Representative Michael A. Barbieri (Newark), representative Paul S. Baumbach (Newark), Representative John A. Kowalko Jr. (Newardk South), Representative Sean M. Lynn (Dover) and Republican Senator F. Gary Simpson (Milford).
Prominent organizations that serve Latinos in the state came to support the legislation bringing their staff and volunteers. These were: Casa de Maryland (currently called Casa); La Esperanza from Sussex County; the Latin American Community Center as well as the Delaware Alliance for Community Advancement, both from Wilmington. The last one helps with taxes. A staff of this lorganization expressed that the number of undocumented people reporting their taxes has increased as the proposed legislation requires prof of two years of tax payments. With Casa’s experience on this type of legislation in Maryland, one of its representatives was critical in organizing the hearing testimonies. They also provided insights in the unintended consequences of the fingerprint requirement.
Givvel Marrero, a well-known community leader and businessman contributed the poster and signs that were displayed at the East side Legislative Hall.
The testimonials presented delivered a compelling narrative. A woman said: “I represent the courageous Latina mothers. I teach my children that they should obey and respect the law. And what could I have answered to my child when he posed this question: ‘Mom, and how is it them that you drive without a driver’s license?’”
The owner of a concrete company expressed his company hires at least 12 people and have been in business successfully for 15 years, yet he do not have a driver’s license to take his son to the hospital in emergency situations as the son was borne with a special condition.
Hoy en Delaware, El Tiempo Hispano as well as representatives of La Exitosa joined us for the Rally and Hearing. The effect of the radio was expressed in the most effective way: a group of landscape workers heard on La Exitosa Radio in Milford about the Rally just few minutes before it started. They jumped on the truck and managed to get to attend the hearing and testify: “I got a good job in landscaping with a good boss. I am ready to be promoted, but my boss cannot allow me to drive the truck for the lack of driver’s license. So we are stack and cannot grow, even though we are ready for it. The Driving Privilege Card will help our business to grow, and therefore the economy of the state to benefit by it.”
Members of the Delaware Hispanic Commission, among them, Javier Torrijos, María Matos and Claudia Porretti have met with Senators and State Representatives to discuss the legislation with legislators.
Besides the sponsors of the bills, Darlene Battle, Pastor Bruce Gillette, Miguel Tapia and Javier Torrijos spoke in behalf of the community.
At the Hearing, supporting organizations sent their representatives: Charlotte King from the League of Women Voters; Rev. Sandra Fontanez from COPAD; Father Chris Posch from the Catholic Church; and Councilwoman María Cabrera and Hispanic Liaison Chico Rodríguez from the City of Wilmington. The former and current Secretary of the Division of Motor Vehicle, Jennifer Cohen and Scott Vien attended the hearing.
Where do we go from here? How Democracy works for the benefit of all? The discussion of the bill has started. Legislators need to hear from their own constituencies. All it will take is a phone call or e-mail. The estimated number of undocumented people that will apply for driving privilege cards is 35,000. Una llamada telefónica: El próximo paso para obtener Permiso de Conducir
Las oficinas del Senador Bryan Townsend y Darlene Battle, la fundadora de la Coalición Unida para Caminos Más Seguros Para Todos Los Delawareños, organizaron los esfuerzos para realizar la primera Concentración y Audiencia de la legislación sobre Permisos de Conducir y el Acta de la Confianza en el Palacio Legislativo, el 10 de Junio, 2015, en Dover. La legislación pasó a ser discutida por los Senadores y ese fue un triunfo.
Los auspiciadores de la legislación de Permisos de Conducir SB59 y el Acta de la Confianza SB60 provienen de diferentes partidos políticos. El originador de esta legislación es el Senador Demócrata Bryan Townsend (Newark). Los auspiciadores adicionales son: el Senador Demócrata Robert I. Organizaciones prominentes que sirven a la comunidad Latina vinieron con sus empleados y voluntarios. Entre otros, estos fueron la Casa de Maryland (actualmente llamada Casa), La Esperanza del Condado de Sussex y Latin American Community Center (LACC), así como la Alianza de Delaware para el Avance Comunitario (DACA), las dos últimas de Wilmington. DACA ayuda a declarar impuestos. En la Audiencia, una empleada de DACA expresó que ha habido un incremento de declaraciones de impuestos entre la comunidad sin documentos en miras a que la nueva legislación requiere prueba de pago de impuestos por dos años. La experiencia de Casa con este tipo de legislación se hizo notoria al asistir con la ordenación de los que rindieron testimonio. Ellos también explicaron las consecuencias inintencionadas que pueden provenir de la inclusión del requisito de huellas digitales.
Givvel Marrero, un conocido líder comunitario y hombre de negocios contribuyó la pancarta y las señales, cuyo mensaje decia: “Caminos Más Seguros.”
Los testimonios de los presentes fueron conmovedores. Una mujer dijo: “Yo represento a las madres valientes que manejan. Yo enseño a mis hijos a respetar y obedecer la ley. Y en qué pude responder yo a mi hijo cuando él me preguntó: ‘Mami, y ¿por qué entonces manejas sin licencia de conducir?’”
El dueño de un negocio “Concreto Express contó que él emplea como 12 personas y ha tenido su exitoso negocio por 15 años, y sin embargo, carece de licencia de manejo cuando necesita llevar a su hijo de emergencia al hospital, ya que el pequeño nació con una condición médica.
Los medios de comunicación hispana estuvieron presentes: Hoy en Delaware, El Tiempo Hispano y La Exitosa. El efecto de la radio se hizo manifiesto fehacientemente debido a que un grupo de trabajadores de jardín escucharon el llamado a asistir a la Concentración en la Radio La Exitosa y lograron unirse a la misma y dar su testimonio en la Audiencia: “Yo conseguí un trabajo en diseño de jardín con un jefe bueno. Estoy listo para ser promovido, pero mi jefe no puede permitirme manejar el camión. Estamos estancados y no podemos crecer. Los permisos de conducir nos ayudarán a crecer el negocio y por ende, la economía del estado mejorará.”
Hay que mencionar y aplaudir a los miembros de la Comisión Hispana de Delaware que se han reunido con Senadores y Representantes para discutir esta legislación: Javier Torrijos, María Matos y Claudia Porretti.
Aparte de los legisladores, otros líderes quienes dieron sus palabras en la Concentración fueron Darlene Battle, el Pastor Bruce Gillette, el excelente estudiante Miguel Tapia y el Presidente Javier Torrijos, quienes representaron a la comunidad.
Otras organizaciones enviaron sus representantes a la Audiencia: Charlotte King de la Liga de Mujeres Votantes; Rev. Sandra Fontanez de COPAD; Padre Chris Posch de la Iglesia Católica; y la Concejal María Cabrera y el Enlace Hispano Chico Rodríguez de la ciudad de Wilmington. La antigua y actual Director/a de la División de Motores y Vehículos Jennifer Cohen y Scott Vien, respectivamente, asistieron a la Audiencia.
¿Qué está por hacerse ahora? ¿Cómo podemos hacer que la democracia funcione en beneficio de esta legislación? La discusión sobre esta legislación ha empezado. Los legisladores necesitan oír de los ciudadanos en su distrito. Todo lo que necesitan hacer es una llamada telefónica o mandar un correo electrónico. El número de personas que se beneficiarían con estos permisos de conducir son 35,000. El número de Senadores es 21, el número de Representantes es 41. ¡Hagan la matemática y veremos que sí podemos lograrlo!
